The auction is organized by BOHEMA New Art Auction House and Gallery Iwona Pleskot, here in after referred to as BOHEMA.
The bidder is only a person who filled application form or bidding order form on bohemanowasztuka.pl website, or logged on bohema.onebid.pl website.
Auctioned positions are objects registered for selling by their owners or creators. According to the given statements objects are their exclusive property or they have an exclusive right to dispose the objects and moreover the objects are not subject to any legal or fiscal proceedings.
Auction is held according to the polish legal regulations and by the person who hereinafter referred to as Auctioneer.
During the auction objects are auctioned in order set in catalogue. Before the auction the Auctioneer informs about bid increments thresholds. The Auctioneer has a right to split or combine objects randomly or withdraw them from the auction without giving reason. Descriptions included in printed and online catalogue of the auction can be updated or changed by the Auctioneer or a person indicated by him/her before the auction begins. Reproductions included in printed and online catalogue correspond with the originals in the most possible way but does not constitute an offer to auction.
BOHEMA can represent the Bidder during the auction on the base of bidding order form. BOHEMA is obliged to buy an object for the lowest price possible offered by the Bidder.
BOHEMA will make every effort to contact the Bidder during the auction , but is not responsible in case of inability to make a connection via phone or internet with the represented Bidder.
Bid increments thresholds are set by the Auctioneer, but usually is not higher than 100pln. Tapping with a hammer by the Auctioneer in a moment of obtaining the highest bid for the auctioned object and means the end of the auction. Tapping with the hammer is tantamount to signing a purchase contract between BOHEMA and the Bidder who becomes the Purchaser of the object. In case of a dispute during the auction the Auctioneer will decide the dispute or will perform re-auction of the object.
Every object on the auction has its starting price. It is also the minimum price, below which BOHEMA cannot sell the object.
BOHEMA will add an auction fee of 18% to the auctioned amount. The auctioned amount along with the auction fee include Value Added Tax. BOHEMA invoices VAT margin.
The Purchaser is obliged to pay for the auctioned objects within 14 days from the day of the auction. All transactions are made in polish zloty (PLN). For special request and after previous agreement BOHEMA can accept payment in euro, dollars or pounds. The conversion will be made on the base of National Polish Bank exchange rate increased by 3%.
In case of delay of the Purchaser's payment within regular time BOHEMA may cancel the contract with the Purchaser.
Property of the auctioned object pass to the Purchaser in the moment of payment of the whole price increased by the auction fee. Receiving of the purchased object is possible after the whole payment is done.
BOHEMA does not offer delivery service of the purchased objects, but for Purchaser request can send them on the cost of Purchaser. BOHEMA is not responsible for possible damage of the object during transportation.
Bidder agrees for BOHEMA storage and process his/hers personal data for marketing purposes and in order to participate in auctions. BOHEMA guarantees confidentiality of the data and declares that will not forward them to any other entities and will use them only in order to contact the customer.

Organizatorem aukcji jest BOHEMA Adam Łuczak, zwanym dalej BOHEMA.
Licytującym jest wyłącznie osoba, która wypełniła kartę zgłoszenia lub zlecenie licytacji na stronie bohemanowasztuka.pl, lub zalogowała się w serwisie bohema.onebid.pl.
Przedmiotem aukcji są obiekty zgłoszone do sprzedaży przez ich właścicieli lub twórców. Zgodnie z oświadczeniami powierzone obiekty stanowią ich wyłączną własność bądź mają oni wyłączne prawa do rozporządzania nimi, a ponadto nie są one objęte jakimkolwiek postępowaniem sądowym lub skarbowym.
Aukcja jest prowadzona zgodnie z polskimi przepisami prawnymi przez osobę upoważnioną zwaną dalej Aukcjonerem.
Podczas aukcji obiekty licytowane są w kolejności podanej w katalogu. Przed licytacją Aukcjoner informuje o progach postąpień. Aukcjoner ma prawo do dowolnego rozdzielania lub łączenia obiektów oraz do ich wycofania z licytacji bez podania przyczyn. Opisy zawarte w katalogu drukowanym i internetowym aukcji, mogą być uzupełnione lub zmienione przez Aukcjonera lub osobę przez niego wskazaną przed rozpoczęciem licytacji. Zamieszczone w katalogu drukowanym i internetowym reprodukcje obiektów aukcyjnych, odpowiadają oryginałom w możliwie najwierniejszy sposób, ale nie stanowią oferty aukcyjnej.
BOHEMA może reprezentować Licytującego podczas aukcji na podstawie zlecenia licytacji. BOHEMA zobowiązuje się zakupić obiekt za możliwie najniższą kwotę oferowaną przez Licytującego.
BOHEMA dołoży wszelkich starań, aby skontaktować się podczas aukcji z reprezentowanym Licytującym, ale nie ponosi odpowiedzialności w razie niemożności nawiązania połączenia telefonicznego lub internetowego z reprezentowanym Licytującym.
O wysokości postąpienia decyduje Aukcjoner. Stuknięcie młotkiem przez Aukcjonera następuje w momencie uzyskania najwyższej kwoty za licytowany obiekt i oznacza zakończenie jego licytacji. Stuknięcie młotkiem jest równoznaczne z zawarciem umowy kupna-sprzedaży między BOHEMĄ a Licytującym, który staje się Nabywcą obiektu. W razie zaistnienia sporu w trakcie licytacji, Aukcjoner rozstrzyga spór lub ponownie przeprowadza licytację obiektu.
Każdy obiekt na aukcji ma cenę wywoławczą. Jest to zarazem cena minimalna, poniżej której BOHEMA nie może sprzedać obiektu.
Do kwoty wylicytowanej BOHEMA dolicza opłatę aukcyjną w wysokości 20%. Kwota wylicytowana wraz z opłatą aukcyjną zawiera podatek od towarów i usług VAT. BOHEMA wystawia faktury VAT marża. W szczególnych przypadkach w skład opłaty aukcyjnej wchodzi opłata z tytułu droite de suite wysokości 5%.
Nabywca jest zobowiązany do zapłaty należności za wylicytowane obiekty w terminie 7 dni od dnia aukcji. Wszystkie transakcje zawierane są w polskich złotych. Na specjalne życzenie po wcześniejszym uzgodnieniu, BOHEMA może przyjąć wpłatę w: euro, dolarach albo funtach brytyjskich. Przeliczenie będzie następowało po dziennym kursie średnim Narodowego Banku Polskiego powiększonym o 3%.
W razie opóźnienia Nabywcy w zapłacie w regulaminowym terminie, BOHEMA może odstąpić od umowy z Nabywcą.
Własność wylicytowanego obiektu przechodzi na Nabywcę z chwilą zapłaty pełnej ceny powiększonej o opłatę aukcyjną. Odbiór wylicytowanych obiektów jest możliwy po dokonaniu pełnej zapłaty.
BOHEMA nie oferuje usługi wysyłki zakupionych obiektów, jednak na życzenie Nabywcy może wysłać je na jego koszt. BOHEMA nie ponosi odpowiedzialności za ewentualne uszkodzenia obiektu w czasie transportu.
Licytujący wyraża zgodę na przechowywanie i przetwarzanie przez BOHEMĘ podanych danych osobowych dla celów marketingowych i w celach koniecznych do udziału w aukcji. BOHEMA gwarantuje poufność powierzonych danych teleadresowych i oświadcza, że nie przekaże tych danych jakimkolwiek innym podmiotom i użyje ich tylko w celu indywidualnego kontaktu z klientem.
