GROTIUS HUGO

ON THE LAW OF WAR AND PEACE

THREE BOOKS
IN WHICH THE LAW OF NATURE AND THE LAW OF NATIONS AS WELL AS THE MAIN PRINCIPLES OF PUBLIC LAW ARE EXPLAINED

PWN Publishing House, Warsaw 1957, pp. 569; 582; format 13.5x20 cm

Grotius first presented a complete system of international law as an independent field of law, hence he is called the father of the law of nations. His division of international law into the law of peace and the law of war was widely used until the early 20th century.

He recognized custom and practice, flowing from the law of nature and contract, as the sources of international law. He based international law on the principles of humanism and rationalism, advocated humane treatment of the enemy, prisoners of war, adherence to international agreements, and the non-starting of aggression wars. He recommended the peaceful assertion of one's rights, and considered as permissible only wars (conducted humanely) aimed at defense or the realization of a just right. Among other things, he advocated the right of free use of the seas for all states, humane treatment of prisoners of war, women and children, adherence to international agreements, recommended the peaceful assertion of one's rights, and considered as legitimate and just only wars aimed at defending endangered natural rights. At the same time, he reconciled with the existence of slavery.

The author is considered one of the founders of the law of nature, many of his ideas in the field of regulating relations between nations have not lost their relevance to modern times. Among the fundamental principles of the law of nature, Grotius mentions: 1. respect for other people's property; 2. honoring accepted obligations; 3. compensation for damage caused; 4. punishment for crimes committed
