Henri Benjamin Constant de Rebecque - (born October 25, 1767 in Lausanne, died December 8, 1830 in Paris) - French writer, philosopher and liberal politician of Swiss origin. In his youth he studied in France and Great Britain, among other places.

He is the founder of the modern theory of constitutional monarchy. He creates this concept by expanding Monteskius' tripartite division of power to include royal power - regulating and mediating between other authorities. The royal power is to be both neutral and not take an active part in politics. Executive power is to belong to ministers responsible to the king. Legislative power, on the other hand, is divided into representative permanent (exercised by the upper house of parliament) and representative opinion (exercised by the lower house). In addition to the independent judicial power, which is separate from the other powers, Constant's concept also includes the municipal power, which belongs to the self-government of provincial residents. It was intended to form a counterbalance to the central authority, to oppose its overgrowth. In Constant's idea, power is to be held in check by law, that is, limited. At the same time, it is to be effective, that is, strong.

The great supporters of Constant's constitutional theses were the Calishans, a noble liberal party active in the Diet of the Kingdom of Poland in 1820-1831. In 1831, during the November Uprising, one of the leaders of the Kaliszans, Wincenty Niemojowski, published a selection of Benjamin Constant's political writings under the title "On Constitutional Monarchy and Public Manuscripts."
