Terms and Conditions

1. The subject of the auction are works of art submitted for commission sale by the Committees for a charity auction to the FestivAlt association cooperating with the Róża Wroniszewska Auction House in order to conduct the auction. According to the statements of the Committees, the entrusted facilities are their property or have the right to dispose of them and are not subject to any court or fiscal proceedings, they are free from seizure and lien, as well as any third party claims.

2. The auction is conducted by the Auctioneer, who sets the starting prices, usually it is 10% -50% below the lower estimation limit, decides the amount of increments, resolves any disputes or subjects the object to re-auction.

3. The Auction House guarantees that the features of the auctioned objects are consistent with the catalog description.

4. The person to participate in the auction is authorized by filling in the Bidding Form and accepting the "Auction Regulations".

5. Persons wishing to remain anonymous or unable to participate in the auction in person may commission the Auction House to act on their behalf or bid by phone. These services - telephone line reservation and others - should be agreed with the Auction House. 24 hours at the latest before the bidding begins. Facilities may have reserve prices.

6. The auctioned price, confirmed by a hit of the auctioneer's hammer, is tantamount to concluding a sales contract.

7. The buyer is obliged to purchase the object / objects within 7 days from the end of the auction. If the Buyer fails to comply with the contract, the Auction House may charge a storage fee of PLN 100 net for each day of delay or withdraw from the sales contract with the Buyer.

8. The ownership right to the auctioned object and its receipt takes place after the Buyer pays the entire bid amount together with the organizational fee.

9. The Auction House guarantees the authenticity of the objects presented in the auction catalog for a period of 5 years from the date of sale by the Auction House with reservations: the guarantee is granted only to the direct buyer of the object, the guarantee does not cover subsequent owners of the object.

10. An organizational fee of 10% is added to the bid price. The fee also applies to after-auction sales. The bid amount and the organizational fee are gross amounts. The buyer bears the delivery costs of the auctioned objects.

11. The Auction House is not responsible for hidden physical and legal defects of the purchased objects.

12. All complaints will be considered on the basis of the provisions of Polish law.

13. Registered museums interested in purchasing works put up for auction should inform the Auction House about it at least 7 days before the date of the auction.

14. The Auction House reminds you of the following legal provisions:

and). The Act of 23 July 2003 on the protection and care of monuments:

The removal of objects older than 55 years and with values ​​exceeding the limits specified in the Act on the protection and care of monuments outside the country requires the consent of the relevant authorities.

b). Art. 20 sec. 2 of the Act of November 21, 1996 on museums:

A registered museum has the pre-emptive right to buy a monument sold at an auction in the amount auctioned.

c). Act of November 16, 2000 on counteracting the introduction to financial circulation of property values ​​from illegal or undisclosed sources and on counteracting the financing of terrorism - the Auction House is obliged to collect personal data of Buyers making transactions in the amount exceeding EUR 15,000.

15. Pursuant to the Act (Journal of Laws of 4 December 2017, item 2249), the Auction House is required to collect personal data of customers.

16. Participation in the bidding involves consenting to the verification of personal data and sending correspondence from the Róża Wroniszewska Auction House and the FestivAlt Association to the e-mail address or telephone contact provided. 1. Przedmiotem aukcji są dzieła sztuki oddane do sprzedaży komisowej przez Komitentów na aukcję charytatywną stowarzyszeniu FestivAlt współpracującego z Domem Aukcyjnym Róża Wroniszewska w celu przeprowadzenia aukcji. Zgodnie z oświadczeniami Komitentów powierzone obiekty stanowią ich własność, bądź mają prawo do ich rozporządzania i nie są objęte żadnym postępowaniem sądowym i skarbowym, są wolne od zajęcia i zastawu, a także jakichkolwiek roszczeń osób trzecich.

2. Aukcja prowadzona jest przez Aukcjonera / Aukcjonerkę,  który/a ustala ceny wywoławcze, zazwyczaj jest to 10%-50% poniżej dolnej granicy estymacji, decyduje o wysokości postąpień, rozstrzyga ewentualne spory lub poddaje obiekt ponownej licytacji.

3. Dom Aukcyjny gwarantuje zgodność cech licytowanych obiektów z opisem katalogowym.

4. Do udziału w aukcji upoważnia wypełnienie Zgłoszenia licytacji oraz zaakceptowanie „Regulaminu Aukcji”.

5. Osoby pragnące zachować anonimowość lub nie mogące uczestniczyć osobiście w aukcji, mogą zlecić Domowi Aukcyjnemu występowanie w ich imieniu lub licytować telefonicznie. Usługi te – rezerwacja linii telefonicznej i inne – należy uzgodnić z Domem Aukcyjnym. najpóźniej 24 godz. przed rozpoczęciem licytacji. Obiekty mogą posiadać ceny rezerwowe.

6. Wylicytowana cena, potwierdzona uderzeniem aukcjonerskiego młotka jest równoznaczna z zawarciem umowy sprzedaży.

7. Nabywca zobowiązany jest do wykupu obiektu/obiektów w ciągu 7 dni od zakończenia aukcji. W razie niewywiązania się z umowy przez Kupującego Dom Aukcyjny może naliczyć opłatę magazynową w kwocie 100 zł netto za każdy dzień zwłoki lub odstąpić od umowy sprzedaży z Nabywcą.

8. Prawo własności do wylicytowanego obiektu i jego odbiór następuje po zapłacie przez Nabywcę całości wylicytowanej kwoty wraz z opłatą organizacyjną.

9. Dom Aukcyjny udziela gwarancji autentyczności obiektów zaprezentowanych w katalogu aukcyjnym  na okres 5 lat od daty sprzedaży przez Dom Aukcyjny z zastrzeżeniami: gwarancja udzielana jedynie bezpośredniemu nabywcy obiektu , gwarancja nie obejmuje kolejnych właścicieli obiektu.

10. Do wylicytowanej ceny doliczana jest opłata organizacyjna w wysokości 10%. Opłata obowiązuje również w sprzedaży poaukcyjnej. Kwota wylicytowana i opłata organizacyjna są kwotami brutto. Kupujący ponosi koszty dostawy wylicytowanych obiektów.

11. Dom Aukcyjny nie ponosi odpowiedzialności za ukryte wady fizyczne i prawne zakupionych obiektów.

12. Wszelkie reklamacje będą rozpatrywane na podstawie przepisów prawa polskiego.

13. Muzea rejestrowane zainteresowane zakupem wystawionych na aukcji dzieł winny poinformować o tym Dom Aukcyjny co najmniej 7 dni przed terminem aukcji.

14. Dom Aukcyjny przypomina o następujących przepisach prawa:

a). Ustawa z dnia 23 lipca 2003 r. o ochronie zabytków i opiece nad zabytkami:

Wywóz obiektów starszych niż 55 lat oraz o wartościach przekraczających limity określone w ustawie O ochronie zabytków i opiece nad zabytkami poza granice kraju, wymaga zgody odpowiednich władz.

b). Art. 20 ust. 2 Ustawy z dnia 21 listopada 1996 r. O muzeach:

Muzeum rejestrowanemu przysługuje prawo pierwokupu zabytku sprzedawanego na aukcji w wylicytowanej na aukcji kwocie.

c). Ustawa z dnia 16 listopada 2000 r. o przeciwdziałaniu wprowadzaniu do obrotu finansowego wartości majątkowych pochodzących z nielegalnych lub nieujawnionych źródeł oraz o przeciwdziałaniu finansowaniu terroryzmu – Dom Aukcyjny jest zobowiązany do zbierania danych osobowych Nabywców dokonujących transakcji w kwocie powyżej 15 tysięcy euro.

15. Zgodnie z ustawą (DZ.U. z 4.12.2017 r. poz. 2249) Dom Aukcyjny ma obowiązek zbierać dane osobowe klientów.

16. Przystąpienie do licytacji wiąże się z wyrażeniem zgody na weryfikację danych osobowych oraz wysyłanie korespondencji od Domu Aukcyjnego Róża Wroniszewska oraz Stowarzyszenia FestivAlt na podany adres mailowy lub kontakt telefoniczny. Zgoda ta może być w każdym momencie cofnięta poprzez wysłanie stosownego oświadczenia na adres: Dom Aukcyjnyn Róża Wroniszewska ul. Siemiradzkiego 13/6 31-137 Kraków lub adres e-mail biuro@domaukcyjnyrozawroniszewska, oraz FestivAlt ul. Dietla 29/1 31-070 Kraków [email protected] co skutkować będzie usunięciem danych z bazy.
