Terms and Conditions of KAREA Gemstone Space Online Auction
1. These Conditions of Sale and Terms of Use contain all the terms on which KAREA Gemstone Space Ltd with its seat in Warsaw (00-144) al. "Solidarności" 93, National Court Register: 0000803922, Taxpayer Identification Number: 5252801067, and the Seller (also referred to as “Auctioneer”,"we", "us", "our" and "ourselves") contract with the Buyer (also referred to as “you” and “your”).
2. The subject of the auction is jewellery, watches, decorative arts and crafts and other objects consigned by our customers and owned by the Seller, hereinafter referred to as objects. According to the declarations of persons submitting objects for sale, they are their sole property, are free from legal defects, are not subject to any administrative, court or fiscal proceedings, are free from bailiff’s seizure and lien and other limited property rights and are not subject to any claims of third parties.
3. The objects are described and numbered in the auction catalogue. Descriptions may be changed or supplemented before the auction starts.
4. The Seller reserves the right, at our complete discretion, to refuse your registration or participation in the auction. We also have the right to combine, separate objects and change the order of the auction. We can also withdraw items from the auction sale or add new ones before the start of the auction.
5. Buyers are responsible for satisfying themselves concerning the condition of the property and the matters referred to in the lot description. You are strongly advised to examine personally any lot in which you are interested before bidding. All objects are available to the Buyers to see in person before the auction at the Seller’s premises at the time specified in the catalogue, during the so-called pre-auction exhibition.
6. The Seller recommends that you carefully inspect the objects before purchasing. Each object from the auction offer is a subject to a professional valuation and a detailed catalogue description prepared by experts specialising in antique jewellery and crafts. The objects are valued by an international diamonds, coloured stones, coins, pearls, rough diamonds and jewellery expert. However, if the information provided is not satisfactory or sufficient, we recommend that you contact the Seller in order to request additional photos or information and details regarding the item’s condition by e-mail: [email protected] or [email protected] or by phone: 882 700 122 or 882 700 336. The fact that there are no imperfections stated in the catalogue descriptions or that the object has been restored or has visible damages, does not constitute any grounds for a complaint.
7. All of the auction lots have a specific starting price and a value estimation, i.e. the estimated value of the work. The starting price does not include the auction fee of 18% of the hammer price. Estimation is determined by the Seller and cannot be equated with the actual market value of the item. The objects also have a reserve price known to the Seller. It is the lowest price agreed with the Owner, for which the Seller may sell the object. The reserve price cannot be higher than the lower estimate.
8. The auction is conducted in accordance with the rules of Polish law.
9. The auction takes place only on the Internet and during the time specified in the auction catalogue and/or on the relevant page, based on the catalogue of objects provided on the relevant websites and appropriate electronic media.
10. You can participate in the auction through a dedicated website, in accordance with the Terms and Conditions of participation in the auction contained on this website.
11. Anyone who wants to take part in the auction is required to register in advance in the online system of a given website, according to the scheme presented on that website, 24 hours before the start of the auction. Registration and its confirmation by the Seller is a necessary condition for participation in the online auction. The Seller has the right to refuse a legal entity or a natural person to participate in the auction without giving a reason.
12. The objects are auctioned from the starting price up. The auction is carried out in accordance with the table of increments.

13. The end of the bidding and the sale are confirmed by the online bidding service. The Buyer is the person offering the highest price indicated by the service. This equates the conclusion of an Agreement between the Seller and the Buyer (pursuant to Article 70.2 § 2 of the Civil Code).
14. Conclusion of a conditional sale means that the Buyer is obliged to buy the object if the Seller, after a prior consultation with the Owner, agrees to sell the item at the offered price. The Seller has 5 business days to obtain the consent and inform the Buyer about the terms of sale. The buyer can also buy the object at the reserve price. In the case of another bidder offering a reserve price, the Seller shall give the Buyer priority to purchase at this price.
15. The participant is not entitled to withdraw from the contract concluded in this way.
16. In the case of a dispute, the Seller shall settle the dispute.
17. The Seller issues a VAT margin scheme invoice for the objects sold via the online auction. The Seller issues a certificate of authenticity of the purchased item signed by a Karea Gemstone Space expert.
18. The Buyer is obliged to pay the amount due for the purchased objects within 7 business days of the auction. After the prior consent of the Seller, it is possible to pay a 20% deposit and purchase it within 14 days of the auction.
19. If the Buyer fails to comply with the terms of the Agreement, the Seller may withdraw from the Agreement concluded with the Buyer by submitting a unilateral declaration of will in this regard. The Seller also reserves the right to pursue the performance of the Agreement in court and to charge the Buyer with any resulting costs. Failure to comply with the terms of the Agreement by the Buyer will also automatically entitle the Seller to ban the Buyer from participating in the Seller's future auctions.
20. The Buyer’s premium fee of 18% is added to the hammer price. This fee also applies to post-auction sales, i.e. after the end of the auction. The post-auction sale of objects is also subject to the terms of sale set out in the Auction Terms and Conditions.
21. Payments can be made in cash directly at the company's office, by card (we accept VISA and MasterCard cards) or by bank transfer to the account indicated in the catalogue and on the website, account number PKO Bank Polski 39 1020 4900 0000 8202 3244 6774. The transfer title should include: the title and date of the auction as well as the number and a short description/name of the purchased object.
22. In the case of payments in other currencies, the amounts will be registered at the current NBP currency exchange rate. Additionally, the Seller adds 1% of the total amount due for handling a currency transaction.
23. The Buyer becomes the owner of the purchased item upon making the entire payment, which completes the sale process.
24. The collection of the object purchased during the auction is possible immediately in the case of cash payment. In the case of a bank transfer payment, the collection of the object is possible in person when the full amount for the purchased object or objects is credited to the Seller's bank account. The object may be handled to the Buyer upon confirming the Buyer's identity with an ID card/document or to the Buyer’s Representative on the basis of a written authorisation.
25. If the object is not collected within 30 days from the date of purchasing the object, the Buyer will be charged with storage costs in the amount of 2% of the selling price per month, unless it has been agreed individually with the Seller.
26. At the request of the Buyer, the Seller may send the purchased item which will be shipped to you at your expense and pursuant to the instructions you provided at time of payment. The above amounts, as agreed with the Seller, must be paid before the object is shipped. The Seller is not responsible for damage or loss of the shipment during transport. The storage and shipping of the items is at the Buyer's expense and risk.
27. The Seller confirms the authenticity and other features of the object described in the catalogue. However, if the description turns out to be inconsistent with the actual state of the item in a significant way, the Buyer may return the item to the Seller within 14 business days from the date of the auction, in which case the Buyer will be issued a full refund of the amount paid. Contesting the catalogue description must be supported by a credible expert’s opinion.
28. The Seller is not responsible for any hidden physical and legal defects of the purchased objects.
29. The Polish registered museums have the right of pre-emption at the hammer price, provided that they report it immediately after the auctioning of the object is finished. It can be done by representatives of museums who have presented their power of attorney for purchase on the day of the auction at the latest.
30. The Buyers' personal data remain for the sole information of the Seller. The Buyer agrees to holding and processing by the Seller the personal data provided for the purposes necessary to conduct the auction and to conclude and perform the contract for the sale of the item. The legal basis for the processing of personal data, the purpose of personal data processing, information about the recipients of personal data, data transfer, data storage period, information on access to data and Buyer's rights with regard to the processing of Buyer’s data and other necessary provisions regarding personal data contained in the privacy policy on the Seller’s website. The processing of Buyer’s personal data takes place on the basis of the rules for the processing and storage of personal data adopted by the Seller.
31. The Seller shall not be liable for any problems related to the participation in the online auction, caused by conditions beyond the control of the Seller and beyond their reach, e.g. for failures of any Internet and telephone connections (domestic and foreign), as well as other failure of equipment not owned or looked after by the Seller.
32. The Seller reminds that in accordance with the provisions of Polish law, the export of objects outside the Polish borders requires appropriate permissions.
33. When deciding to participate in the auction you confirm that you have read and are bound by these Auction Terms and Conditions and the information clause regarding personal data referred to in point 30 above and that you accept them fully.
